Abstract
This Article examines a regulatory alternative to legislative proposals for minimizing harmful content on social media. Some proposals would require platforms to moderate specific types of content, while others would remove some or all of the liability protection that Section 230 of the Communications Decency Act provides to social media platforms. These proposals face significant opposition on the grounds that they violate the First Amendment and would trigger extreme censorship by social media platforms.
